UCCJEA

If minor children are in the custody of the parties when the Petition is filed, the parties must file a Declaration Under Uniform Child Custody Jurisdiction and Enforcement Act (UCCJEA), to determine who will have custody after altering the marriage contract. This form is also known as FL-105 (here).

INFORMATION REQUIRED
The party must provide each child's name, place of birth, date of birth, sex and residence for the last FIVE years. Each residence will be listed by address, as well as the person whom the child lived with and that person's relationship with the child.

The court will also want to know information surrounding your participation as a party or a witness in another litigation or cusody proceeding, in California or elsewhere concerning custody of a child which is subject to the UCCJEA proceeding. If you have information about a custody proceeding currently pending in a California court or any other court concerning a minor child involved in your case, you must provide that information.

If any other person (such as a grandparent, or caregiver) who is not a party this proceeding who has physical custody or claims to have custody of or visitation rights with any child in your case, you must provide the name and address of that person and the name of each child.

DOMESTIC VIOLENCE/RESTRAINING ORDERS
If there are any domestic violence restraining/protective orders which are currently in effect, information regarding the court, type of case (criminal, family, juvenile), and case number must be provided.

CHANGE OF INFORMATION
If this information changes at some point in time during any part of your case, you have a duty to inform the court (and your attorney) of any changes.
