Family Law :: Legal Separation

A person who does not wish to end a marriage may seek a legal separation. A legal separation can be filed by a married person who wishes to retain his or her marital status. The court will issue orders regarding custody and visitation of the minor children, spousal support, child support, domestic violence restraining orders, and division of community and separate property. A person may prefer legal separation based on religious reasons.

There is no residency requirement to file for a legal separation. If you wish to get a divorce after legally separating, you must fulfill California’s residency requirement. At that point in time you may file an amended petition and ask the court for a divorce after meeting the residency requirements.

Upon filing a Petition for legal separation, the Petitioner must personally serve the Respondent. The Respondent must file a response within thirty (30) days from the date of service, and the matter will then proceed as either contested or uncontested. If the Respondent fails to respond within thirty (30) days of service, the Petitioner may request an entry of default. When the default is entered, the Petitioner can complete the legal separation proceeding without the Respondent.
