Probate Guardianships
Sometimes an adult needs to obtain probate guardianship of a child because the adult needs the legal right to make decisions on behalf of a child. There are several instances in which parents may not be able to take care of their child, including: military obligations, physical illness, drugs, jail, and child abuse. There are two types of probate guardianship proceeds which a client can seek: guardianship of the person and guardianship of the estate (or both).
Guardianship of the person means that the guardian has custody of the child. A guardian can obtain full legal and physical custody of a child and is responsible for any basic or special needs which a child might have. A guardian has essentially the same responsibilities as a parent.
Guardianship of the estate means that the guardian will manage the child’s income, money or other property until the child turns 18. If the child inherits a large amount of money or property, he or she may need to have a guardian appointed to carefully manage the child’s assets.
Guardianship is different from adoption. In an adoption, the parents’ rights are permanently ended, whereas in a guardianship, the parents still maintain their parental rights and can have reasonable contact with the child. Unlike an adoption, the Court can end a guardianship if the parents become able to take care of the child. Also unlike an adoption, guardians can be supervised by the Court.
