Divorce in California
A divorce can be filed by the petitioner to legally end the marital relationship between the husband and wife. A divorce restores the parties to their original status, meaning that you will be able to marry again. At the time of the divorce, an individual can ask the judge to issue orders regarding child support, custody and visitation of minor children, spousal support, domestic violence restraining orders, and division of community and separate property.
In order to get divorced, you must meet California’s residency requirement. The petitioner or the respondent must have lived in California for the last 6 months, and you must have lived in the county in which you plan to file the divorce for the last 3 months. Upon filing for divorce, the Petitioner must personally serve the Respondent. The Respondent must file a response within thirty days. The divorce will then proceed as either contested or uncontested depending upon whether the parties are in agreement on all issues. If the Respondent fails to file a response within thirty (30) days of service, the Petitioner may request an entry of default. If the judge enters default, a Petitioner can complete the divorce without the participation of the Respondent.
