If the parents file for dissolution, separation, nullity, or if either files a petition for custody and support of minor children’s action, then the Court will address issues involving child custody and visitation.
There are several ways to determine custody and visitation of minor children. First the parents can agree on custody and visitation and sign a stipulation which is then presented to a Court for approval. Second, if the parents cannot agree on custody and visitation, the Court will order the parents to mediation with the Family Court Services Department or with a private mediator hired by the parents. Either way, the goal of determining custody and visitation of the minor children is to develop a parenting plan that is in the best interests of the child. You will want to determine which parent(s) has physical custody over the child and which parent has legal custody (the ability to make decisions about the lifestyle of the child.
