Family Law :: Child Support

The Court can make a child support order when the parties get a divorce, legally separate, nullify the marriage, or when a parent establishes parentage or domestic violence restraining order is issued. A parent who files a voluntary Declaration of Paternity or parents who are married but don’t want to get divorced can file a Petition for Custody and Support of Minor Children (FL-260). The Court may order one parent to pay child support every month for a child until the child turns 18, or 19 if the child is still in high school, living at home, and cannot support himself or herself.

Child Support is calculated based on: the earning capacity of the parents, the income of the parents, number of children, the amount of time spent with the child, tax filing status of each parent, support from other relationships, health insurance, union dues, retirement contributions, and daycare costs among other matters such as travel and education of the child. The State of California provides a Guildeline Child Support Calculator (here) to help determine the amount of child support a parent may have to pay for a child.

The parents of course can agree on a different support amount provided certain conditions are met, among them that they are not pressured or forced to agree to the amount, that they are not receiving public assistance and that a judge approves the amount of child support payments, among others.

A parent may wish that the amount of child support be changed based on a change of circumstances between one or both of the parties. You may wish to consult with an attorney before filing a motion to change a child support order. Double-check the Child Support Calculator to see if the difference in child support payments is worth the cost of going to court. You can also find out if there has been a change in the amount of the other parent’s income if the court has entered Judgment by filing and serving a Request for Production of an Income and Expense Declaration After Judgment (FL-396) and an Income and Expense Declaration (FL-150).
